Terms and Conditions

Terms and Conditions of Service

These Terms and Conditions ("Agreement") constitute a binding agreement between Minuteman Lighting, a division of Legacy Exterior Solutions ("Contractor", "we", "us"), and the property owner or authorized agent ("Client", "you") identified in the associated estimate or invoice.

By accepting a quote or scheduling a service with Minuteman Lighting, you agree to be bound by these terms.

1. Scope of Work

Minuteman Lighting agrees to furnish the labor and materials specified in the estimate provided to the Client. We are an authorized installer of the HAVEN® permanent lighting system.

  • Modifications: Any changes to the scope of work (e.g., adding extra lights or zones) after the agreement is signed must be agreed upon in writing and may result in additional charges.
  • Accuracy: The Client is responsible for the accuracy of the property lines and ensuring the installation does not encroach on neighboring properties.

2. Payments and Deposits

  • Deposit: A non-refundable deposit of 50% is required to schedule your installation date and order materials.
  • Final Payment: The remaining balance is due immediately upon substantial completion of the installation.
  • Late Fees: Invoices not paid within 7 days of completion may be subject to a late fee of 1.5% per month or the maximum allowed by law.
  • Title: All materials and equipment remain the property of Minuteman Lighting until the invoice is paid in full.

3. Scheduling and Site Access

  • Access: The Client agrees to provide Minuteman Lighting with access to the property, including driveways and outdoor electrical outlets, during the scheduled installation times.
  • Weather: Installation dates are subject to weather conditions. We reserve the right to reschedule services if conditions (rain, high winds, snow) are unsafe for our crew or equipment.
  • Delays: We are not liable for delays caused by supply chain shortages, manufacturer shipping delays, or acts of God.

4. Warranties and Service Plans

  • Manufacturer Warranty: The lighting hardware (LEDs, tracks, controllers) is warranted solely by the manufacturer, HAVEN Lighting, according to their terms. Minuteman Lighting will assist in filing warranty claims, but we are not responsible for manufacturing defects.
  • Standard Labor Policy: Unless an extended service plan is purchased, Minuteman Lighting provides no additional labor or workmanship warranty. Any service calls, repairs, or troubleshooting required after the initial installation will be billed at our standard hourly service rate.
  • Annual Protection Plan: The Client may purchase an extended labor and maintenance warranty at a rate of $350.00 per 100 feet of lighting installed, charged annually. This plan covers labor for repairs, connection checks, and warranty processing for as long as the plan is active and in good standing.

5. Technology and App Usage

  • Connectivity: The HAVEN system requires a stable Wi-Fi connection to function properly. Minuteman Lighting is responsible for installing the hardware but is not responsible for the strength, speed, or reliability of the Client’s home Wi-Fi network.
  • App Updates: Usage of the HAVEN cloud-based app is subject to HAVEN Lighting’s terms of service. We are not responsible for software updates, app downtime, or compatibility changes made by the manufacturer.

6. Limitation of Liability

  • Incidental Damage: While we take great care, Minuteman Lighting is not liable for minor cosmetic damage to landscaping or incidental damage to unseen underground utilities (e.g., dog fences, sprinkler lines) unless their location was clearly marked by the Client prior to arrival.
  • Indemnification: The Client agrees to indemnify and hold Minuteman Lighting harmless from any claims, damages, or expenses arising from the Client's breach of this Agreement.

7. Marketing and Media

The Client grants Minuteman Lighting the right to take photographs or video of the project property for marketing, portfolio, and social media purposes. We ensure that no personal details (names, house numbers) are prominently displayed without consent. If you wish to opt out, please notify us in writing before installation begins.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Kentucky.

9. Acceptance

Authorization to proceed with the work, whether by written signature, email confirmation, or payment of a deposit, constitutes acceptance of these Terms and Conditions.

At Minuteman Lighting, a division of Legacy Exterior Solutions, we pride ourselves on delivering premium, custom-fitted permanent lighting solutions. Because our systems are architectural modifications tailored specifically to your home’s dimensions, our return and refund policies are as follows:

1. Custom Nature of Services

Our lighting tracks are custom-measured, cut, and color-matched to fit your specific property. Once materials have been cut or installed, they cannot be returned, restocked, or resold. Therefore, all sales are final upon the commencement of installation.

2. Deposits and Cancellations

  • Non-Refundable Deposit: As outlined in our Terms and Conditions, the 50% deposit required to book your project is non-refundable. This deposit covers the upfront cost of ordering your specific materials and reserving your installation date on our schedule.
  • Cancellation Prior to Installation: If you cancel your project after the deposit is paid but before installation begins, you will forfeit the deposit. You will not be charged the remaining balance.
  • Cancellation After Installation Begins: Once our crew arrives on-site and installation begins, the full balance of the project is due. No refunds will be issued for labor or materials once work has commenced.

3. Refunds on Labor

Labor costs are strictly non-refundable. Our technicians are paid for their time and expertise in installing your system. Once the work is performed, the labor portion of your invoice is considered fully earned and final.

4. Defective Hardware (Warranty Claims)

We do not offer cash refunds for defective hardware (lights, controllers, power supplies). instead, defective items are handled under the Manufacturer Warranty provided by HAVEN Lighting.

  • Remedy: If a component fails within the manufacturer's warranty period, we will facilitate the replacement of the part.
  • Labor Costs: As per our Terms and Conditions, unless you have purchased our Annual Protection Plan, standard service rates apply for the labor required to diagnose and replace defective parts.

5. "Change of Mind"

We encourage all clients to review their lighting design and track color choices carefully before approving the estimate. We do not offer refunds or free re-installations if a client changes their mind regarding the color, placement, or design of the system after the materials have been ordered or installed.
